TERMS AND CONDITIONS OF SALE
Title to, and ownership of, all bottles pass from TK Wine to the customer once payment has been made. By aiding the customer to arrange transportation of the wine to the customer’s designated shipping destination, TK Wine is providing a service to and acting on behalf of the customer. By utilizing this service, the customer is representing that they are acting in a fashion compliant with their local and state laws regarding the purchase, transportation, and delivery of wine. Each state has its own regulations regarding the personal importation of alcohol products to an individual shipping his/her own product to themselves. The customer should check their state regulations and represents that they have obtained any required permission, paid any required fees, is working through properly licensed intermediaries where required, is legally entitled to take possession of the wine and is legally entitled to take quantities ordered and once again authorizes that they are 21 years of age.
Age Requirements
By making a purchase through tkwine.com, customers assert that they are at least 21 years old. All shipments including alcohol require an age verification. It is illegal for anyone under the age of 21 to attempt to purchase alcohol and TK Wine will comply with any legal entity in pursuing prosecution of the underage purchase of alcohol.
Representation of Salability
TK Wine makes every attempt to provide bottles that are in excellent condition. We will include notes in our listings so that you understand the condition of the bottles you are purchasing. The pictures that you see in our listings are of the actual bottle being sold. In cases of large lots, the bottle with the lowest condition will be pictured. Unfortunately, in most cases, it is not possible to detect spoilage and all of our bottles are sold as-is.
Pricing and Availability
Pricing and availability are subject to change without warning. Due to the nature of our sourcing, the same wine or spirit may be posted at different prices based on condition or purchase price.
Our products are not removed from our website until checkout has been completed, as such, orders may need to be cancelled based on lack of product inventory.
Taxes
Because title to and ownership of the wine or spirits purchased transfers to the customer at the time of payment, the transaction takes place in California regardless of the state in which the customer resides. California sales tax will be charged for all orders.
Return Policy
All sales are final. We do not issue refunds on wine or spirits that are deemed spoiled. Return requests are accepted within one week after receiving your order if the bottle is significantly different from the description in our listing. Only unopened bottles are accepted. Any time an exception to this policy is made, a 5% restocking fee will be applied to cover our costs for any returns.
Holding Purchases for Shipment or Personal Pick-up
The customer owns all products at the time of purchase. TK Wine will transfer the product(s) after purchase to an independent temperature controlled partner storage facility for holding until the customer either arranges for shipping of the product to themselves via a common carrier or to have the product physically picked up. According to the storage facility’s policy, bottles that are held longer than 90 days will incur a monthly storage cost of a minimum of $1 per bottle at the beginning of each month until the purchase is picked up or shipment arrangements have been made with the carrier of your choice. The summer months of June, July, and August will no longer count against the 90 day waiver of fees. The storage facility’s policy is to reserve the right to charge additional fees for large orders or orders held for long periods of time. All orders held longer than one year from the date of purchase will be considered forfeited.
Shipping
Ground packages are typically shipped on Monday and Express packages Monday and Wednesday. Packages are shipped via FedEx, UPS, or GLS for local express. Alcohol can not be shipped to a PO Box or APO address.
Delays and other issues in transit are beyond the control of TK Wine.
Age Requirements
Due to federal and state regulations, all wine shipments must be received by an adult 21 years of age or older. An adult must be physically present to sign for the wine delivery. The person receiving delivery will be required to show identification proving that they are at least 21 years old. We highly recommend that you provide a business shipping address for best service.
Delivery Options
Orders are shipped via FedEx, UPS, and other carriers. Shipping costs will be calculated at checkout. Federal regulations make it illegal to ship wine to a P.O. Box or APO address. If you enter a P.O. Box or APO address as your shipping address, the wine will be returned to us and you will be charged for the original shipment,  the return shipment and the subsequent shipment to a valid street address.
You may choose any of the following delivery options.
Domestic Only:
Ground – One to five business days in transit, depending on the location
2 Day – Two business days in transit
Standard Overnight – One business day in transit
*To ensure faster delivery, we recommend using a business address.
Insurance
While we make every effort to package and ship orders carefully and securely, courier companies do not take on any liability for items lost or broken in transit. To address this, TK Wine offers insurance in order to provide a method to cover items lost or broken in transit. 
Please note that this insurance provides coverage for breakage and loss during transit only. Insurance does not cover any loss arising from an item’s condition. Therefore, it will not protect against seal failures or cosmetic damage to lots. It also does not protect against leakage or damage due to temperature or pressure issues.
For your convenience, a 3% insurance fee is automatically selected at checkout. However, if you do not wish to apply this insurance on your purchase, please de-select this checkbox when completing your order.
Shipping Rates
Shipping and handling rates will vary based on where a package is shipped, the number of bottles, and the size and weight of the contents.
Damage during Shipping
TKwine.com is not responsible for wines damaged by heat or cold exposure, including and not limited to leaks. Wines spoiled or damaged by changes in temperature or pressure cannot be recovered. Please be aware of weather patterns along the route of travel and choose your shipping method accordingly.
We carefully pack each order leaving our facility. However, if you receive damaged merchandise, please email info@tkwine.com or call us at (310)926-4951 within 24 hours of receipt. We will ask you to ship back the damaged bottles. As soon as we receive them, we will process a refund for your damaged items.
Incorrect or missing items
Although rare, if you receive the wrong items, we will arrange for a return pick up. If you find that items are missing from your order, please contact within 24 hours of receipt at info@tkwine.com so that we can rectify your order.
Reshipping
When an order is returned after several delivery attempts to the provided address or after a package at a hold location is not picked up, we will assist with making arrangements to have your packages reshipped. Please note that an additional shipping fee will apply.
Customer Pickup
You may also arrange to pick up your purchases at our partner storage facility in Torrance, CA. To do this please email info@tkwine.com or call (310)926-4951. We request at least 24 hour notice before coming to the office to pick up your wines. You will need at least one form of identification and an order receipt.
